Action for wrongful death in the district court for Clay county by the trustee for the next of kin of Lester Hicks, whose death resulted when the truck which he was operating was struck by a train of defendant railroad being operated by defendant Herman Ullrich. The case was tried before W. F. Rogosheske, Judge, and a jury, which returned a verdict for $12,500 against defendant railroad only. Said defendant made an alternative motion for judgment notwithstanding the verdict or for a new trial, and from an order denying judgment and granting a new trial, it appeals. AUTHOR: CHRISTIANSON
